We're back at Federal Court, where CPC lawyer Arthur Hamilton is telling the judge we don't expect to get thru everything this week.
The lawyers are willing to sit extended hours or on the weekend. Judge asks about next week. Hamilton has court dates all next week.
We may come back Dec. 20. Clerk is checking sked. Judge says power's shut off on the weekend so that's not an option. I'll keep you posted.
Today we're looking at survey research methodology. Ekos' Frank Graves did a poll for the applicants challenging the 6 elxn wins.
CPC expert Corbin disputes Graves' methods. So here we go...I wish I'd paid closer attn to my quantitative research methods course in uni.
Graves was to find out to what extent voter suppression may have been used in the 6 ridings, whether it affected partic parties...
...& whether it prevented ppl fr casting a ballot who would have voted otherwise. Sampled 2872 ppl. Parallel survey 1500 in other ridings
Shrybman quoting from Graves' report: highly likely the initial voter ID linked to subsequent misleading call to non-CPC voters.
RT @glen_mcgregor: Polls were changed in only one of the six ridings, so this information a poll relocation "was almost always false," G ...
I'd like to see which ridings used for comparison. Elxns Cda now investigating complaints of misleading or harassing calls in 243 ridings.
A remarkable feature of the calls, Shrybman says, is that they were reportedly dramatically more likely to hit non-Conservative supporters
If he had another day, Shrybman says, he'd walk us thru this in more detail. If YOU want more, readers, report's on Council of Cdns website.
Shrybman says much of the debate around Ekos evidence is whether it establishes ppl didn't vote because of the calls. He says it shows that.
Graves did a correlative analysis, Shrybman says, to try to assess from another angle.
Shrybman says CPC expert Corbin expert in mkt research, not same domain as Graves.Didn't review 2nd expert's report supporting Graves' work
RT@VoiceOfFranky: The comparisons best thought of as places representative of ridings with much lower (rather than no) incidence of calls.
RT@VoiceOfFranky: 'control' group only applies to random assignment. Can't be used with events in past. Random comparison useful alternative.
I'm being prodded to remind why DonValleyEast out of case.Voter didn't know she actually lived in DVWEST.Only 1 who said call kept fr voting
Other Corbin complaint was methodology not laid out in report. @voiceoffranky posted on website--Industry standard.
Another Corbin criticism was possibility of ineligible voters answering (kids, non-cdns) or ppl making up answers.
Shrybman says no evidence that's a common phenomenon, but if it were, would be spread among results, inclu control group.
Aw, CPC lawyer Arthur Hamilton just reminded Shrybman to turn his mic off while Shrybman talked to CoC ppl like Maude Barlow.
Judge reports we can have the courtroom on Monday to continue proceedings.
A brief pause while looking for dox allows Shrybman and Hamilton to chat, and me to wish I could take pix of the 5 6-8 inch stacks of dox
Also pix of this beautiful art deco room.
Hamilton is up to tell judge that when @voiceoffranky left the room Monday during the cross, he went on Twitter to see reporter tweets.
Hamilton says he will provide documents to support this. Shrybman says he only just learned of this. Judge says policy permits social media
Judge gently reprimands reporters 4 tweeting live instead of waiting for Graves' return.Says may have been oversight for him not to make clr
Shrybman up to say what happened when Graves out of court was reported in news stories, not just Twitter. Says it's a very serious problem
Problem not that Graves went on Twitter, Shrybman says.
I'm not sure why we weren't supposed to tweet/report when public was allowed to remain. No 1 was asked to leave court at same time as Graves
RT @glen_mcgregor: Judge Mosley allows that it is rare to have witnesses in Federal Court. He will address this further at lunchtime.
Shrybman reading character references for Graves fr competitor Michael Adams and others. Combating Hamilton's assertion he isn't reliable.
RT @glen_mcgregor: Adams said CPC MPs' attack on Graves, who he acknowledges as competitor in polling biz, was unfounded.
Hamilton says @voiceoffranky is threatening to sue him, has media reports about it. Shrybman says Hamilton offering testimony again
Shrybman answers a Q I was about to pose to Twitterverse: there is privilege attached to statements in judicial documents...
...Regardless of how libelous or defamatory. Like Parliament, I imagine?
Shrybman says Graves has decades of practice; respondents say he claims to be expert when isn't; Shrybman says Graves never claimed that
CPC says Graves claims to be PhD. Was in footnote in one affidavit added by Shrybman's law firm. Shrybman says Graves has explained it.
Graves had it corrected immediately, posted note online. Shrybman's firm apologized for error.
