Justice Then is settled in. Just waiting for the jury
Foricllo's wife has also come in -- she's sitting in the front row of the public gallery on the left.
Yatim's mother has also arrived at courtroom. She's sitting in the front row of the public gallery on the right.
Crown Milan Rupic is expected to continue his cross examination of Constable Forcillo.
Forcillo has arrived. His wife isn't here. I saw Sammy Yatim's mother enter the court house about a half hour ago.
The court was dealing with matters outside of the presence of the jury this morning. We can't report on any of it for that reason.
Good afternoon. Sitting in trial of Forcillo waiting for the public part of the court hearing to begin for the day.
As for the second volley of shots, "If I had known everything I do now, I would never have taken the second volley."
Forcillo said he would not have done anything differently when firing the first shots at Yatim.
Said at police station, his colleagues kept coming in to ask him if he's ok. Said he had to go to the washroom often
Forcillo said he was shaking like a leaf after the shooting. Said he was in shock
He said about Yatim: "He was one of the most determined poeple I've ever had to deal with."
Said no one was more shocked than he was when he saw what was on the video -- that Yatim didn't get up
Forcillo says Yatim rolls onto his back after the first shots and looks like he's going to get up. Says sees him pick up the knife.
Judge Then tells jury that the demonstration video they saw was accompanied by language from officer forcillo. He instructed the jury what you rely on is the evidence on witness stand not what said in video as evidence in case
Taking a quick break before we resume
Very strange seeing Forcillo in a video playing Sammy Yatim.
Forcillo admitted that according to the security videos from that day, Yatim did not try to get up.
He demonstrates how Yatim is holding the knife and after Forcillo shoots Yatim the first time, he drops the knife after falling backwards. Forcillo demonstrates in the video a recreation of what he says is Yatim picking up the knife with both hands and says in the video that he perceives Yatim is getting up at a 45 degree angle before Forcillo fires another 6 shots in Yatim's direction. The whole event from Forcillo arriving to the shootings is about 50 seconds
Said he was assessing whether the shots were effective and whether Yatim continued to pose a threat.
Said after the first shots fired, paused to assess the situation. Said Yatim had dropped the knife after the first volley of shots a few inches away from his right hand.
'
said couldn't see any blood.
Said when fired the first round of shots knew he had hit Yatim but didn't know where.
Said he was about to make the biggest decision of his life -- said he had tunnel vision at the time.
"As a police officer, we're always at a disadvantage when it comes to reaction times having your firearm out takes a few seconds off that equation,"
Forcillo said he saw a young fit male and knew he could move quickly.
Said you don't assume that he doesn't know how to use the knife and assume he can cover a significant amount of distance very quickly.
Said first glimpse of Yatim on streetcar, "He's showing me the knife." He said he didn't pull out his gun until he saw the knife, exactly as his training dictates.
Forcillo said Mr. Warshaw wasn't standing on Dundas street that night, wasn't facing Yatim who was flicking a knife at him. "Mr. Warshaw is very willing to gamble with my life."
Defence lawyer asked Forcillo what he thinks of Crown's use of force expert saying he could have done other things other than shoot Yatim.
The only conclusion Forcillo can come to after thinking about this thousands of times was he was coming off that streetcar.
Said gave Yatim loud clear instructions. he's completely unafraid of Forcillo. His face is clenched. It looks like the calm before the storm. He continues to come forward
Forcillo said he believed Yatim made a deliberate decision not to comply.
When he ordered Yatim to drop it one last time, he said no.
Said if Yatim had stopped advancing, "he wouldn't have gotten shot, none of us would be here."
First thing Forcillo said he sees as Yatim comes around the corner toward the front doors is the knife up
Forcillo said as Yatim is coming forward, it looks to me like he's bracing himself
Forcillo said he saw Yatim flick the knife at him which he saw as an indication that he was coming. "In my mind, he's coming off that streetcar to attack me."
Said he had his finger on the trigger of his gun when Yatim initially came towards the steps of the front doors of the streetcar. Forcillo said it was too close. When Yatim moved back into the streetcar Forcillo said it was a relief. "My goal was to tell him to stay over there so I wouldn't have to shoot."
He said he felt yelling at Yatim to drop the knife and back up was partially successful. He said Yatim did move back. He said his training taught him that he should try something else which was to lower his tone a bit and warn him, "If you come one step in this direction, I'm going to shoot you, I'm telling you right now."
Also was worried he would create a hostage situation if he closed the doors because he didn't know whether there were others on the streetcar.
Said would have been a bad idea to close the doors because he would have to move in closer to Yatim with the knife, and he had never flipped the switch at the front of the streetcar to close the doors before.
`Said Yatim was in the moment, making decisions, bad decisions but he was making them.
Says thought Yatim might be going through excited delirium -- he was showing the symptoms but said a person on drugs can be harder to reason with, has higher pain tolerance and can display extraordinary strength in certain circumstances.
