Rupic said the video showed Yatim appeared relaxed before Forcillo shot him. He said Forcillo was rationalizing Yatim's manner after the fact as a reason to shoot Yatim.
Rupic said Forcillo had the upper hand because had his gun out but Forcillo disagreed. Said it shaves off time if subject intends to attack but still dangerous situation.
Rupic said even though Yatim had a knife had no element of surprise -- two officers had their guns drawn .Forcillo said the surprise part comes because he didn't know when Yatim would come forward.
Forcillo said Yatim was absolutely not putting the knife down when he shot Yatim.
Yatim's father is wiping away tears as the Crown is playing another video of the shooting of his son.
"You shot him because he had the temerity to take a step and a half -- 50 cm - at a snail's pace toward you when you told him not to. You shot him because he moved.," stated Rupic. Forcillo denied it
Rupic again put it to Forcillo that he was angry with Yatim because he didn't recognize Forcillo as the boss in this situation.
It's hard to hear exactly what he said even after we heard it in court again today
Rupic is playing an iphone audio from the scene where the last words that Forcillo said to Yatim: " You take one step in this direction and (unclear) shoot you, I'm telling you right now." Rupic reminded Foricllo that one of the witnesses heard Forcillo say, If you take one step towards me, I will fxxxing pop you..." Forcillo denied that he said it.
It was not Mr. Yatim that was angry. It was you who was angry, said Rupic.
Forcillo said Yatim was using aggressive words and he did not get under Forcillo's skin. Said it looked like Yatim wanted to fight.
Rupic asked Forcillo, Yatim didn't say anything threatening did he? No said Forcillo.
Rupic says Yatim's tone is mocking in video. He was making fun of Forcillo. Forcillo denied it all.
Yatim calls Forcillo "Pxxxxy" many times and says no repeatedly when asked to drop the knife.
Rupic, "You'll agree with me that Yatim's arms aren't tense." Forcillo disagrees.
Rupic said Seymour was successful in de-escalating Yatim and now going to show video of what happens when Forcillo comes on scene.
Rupic asks Forcillo if he would agree that Sammy Yatim didn't appear to be tense? Forcillo said fair comment. Asked whether Sammy Yatim's conversation and tone of voice seem to be a normal tone of voice. Forcillo said up untll a point.
Forcillo said, "Yatim was advancing towards me."
He said he was a hundred percent sure Yatim was coming off the streetcar.
"You shot Mr. Yatim on a mere hunch that he was going to step off the streetcar," said Rupic.
"I have replayed this a million times. Mr. Yatim was coming off the streetcar, it was not a hunch," responded Forcillo.
Forcillo disagreed saying it was the way Yatim looked: "His face was flush, his eyes wide, jaws clenched, muscles tense, his body language was very aggressive and he took a deep breath."
Rupic contended to Forcillo that " You wanted Yatim to seem more dangerous than he was" to justify the shooting.
Forcillo said Yatim was sweating which is one of the indicators. Rupic contended Forcillo was not being truthful: he couldn't see Yatim had a cigarette but he could see how much he was sweating?
Forcillo had said that he thought Yatim had excited delirium. But Rupic taking through each of the symptoms of excited delirium: diminished sense of pain, hallucinations, unexpected strength, hallucinations. Rupic said to Forcillo that he had no indication that Yatim was showing none of those symptoms so how did Forcillo come to that conclusion?
Forcillo said he had partial success with his commands indicated by the fact Yatim stepped back. Said would be full success had Yatim put down the knife.
Forcillo said Yatim didn't seem scared at all when Rupic put that suggestion to him.
Rupic also says Yatim steps back into streetcar behind white line when the two officers point their guns at him.
Forcillo said he doesn't remember that.
Rupic puts it to Forcillo that Yatim stops calling the police pxxxy once he sees the two officers have guns pointed at him
Crown Milan Rupic asked Forcillo that Sammy Yatim had two officers with guns pointed at him -- Forcillo and Constable Kim.
Jury being called in now.
Justice Then has settled in but is dealing with some housekeeping issues with the lawyers before calling the jury in.
Sammy Yatim's mother and father are here in the courtroom today.
It's scheduled to start at 1000.
Good morning. We are back at the Constable James Forcillo trial.
We are breaking for the day to come back for rest of crown's cross tomorrow.
Crown said Forcillo blew off his partner -- her attempts to engage in verbal de-escalation.
A few seconds later Const Fleckeisen tells her partner she's getting out of the way. She turned the scene over to Forcillo. Forcillo said that wasn't true.
Crown accuses Forcillo of interrupting his partner in trying to engage a drug addled teenager having a bad trip.
Forcillo said it was obvious that Yatim didn't want to talk.
Crown points out he's looking out the front windows of the streetcar as other officers arrive when Yatim responds to Const Fleckheisen's only question....
Crown said yes that's what Yatim said but asks whether Forcillo believes it's possible that Yatim didn't understand the question.
Seven seconds after holstering her gun, Crown said Iris Fleckheisen asked Yatim in a calm voice if there was anyone else on the streetcar. Crown asked whether that cold have been the first step in a conversation. Forcillo said yes it could have been but Yatim wasn't interested in a conversation because Yatim's responded with "everyone's a pussy."
