He's dismissing the jury for the day. They will come back tomorrow then be off for a week. He expects the case to conclude on Dec 18. Closings and Judge's instructions are likely to be scheduled for early Jan.
Justice Then telling jurors that one of the jurors is missing. Asked them to speculate why that is but says it has nothing to do with the trial. So now 11 jurors not 12

Forcillo said what TTC driver did was very brave but that Yatim was a different person than the one the driver was dealing with.
Forcillo said it was the correct use of force.
Eligon was in a hospital gown -- left East York General and was in hosptial for a mental health issues. He escaped from the hospital and stole two pairs of scissors from a convenience store. He was shot after being surrounded by 5-6 police officers.
Now Forcillo is recounting the Michael Eligon police shooting which was subject to an inquest looking into police use of force when it comes to people in mental health crisis.
Forcillo said he wasn't angry when dealing with Yatiim - said the name calling "doesn't even rate on a scale. It's meaningless" compared to other things he's dealt with in 14 division.
Brauti now moving to idea that when Forcillo and his partner arrived on scene, Yatim puts his hands up in what Rupic had described as mock surrender -- with both hands up in the air. But Forcillo said he didn't see both hands go up because there was something blocking his vision
Forcillo said his partner Constable Iris Fleckeisen said she was moving away from the line of fire so to speak so she could work the radio not because she was disgusted with the way Forcillo was handling the situation.
Brauti going over the references made about Forcillo's partner having 22 years experience. Brauti asked why she didn't confer with Forcillo. Forcillo said they work together often and they don't need to have a discussion about what actions they should each take.
Said he never thought about it.
Said he didn't even turn his mind to whether to use pepper spray the night Yatim was shot.
Forcillo said pepper spray was not something he thought was the right thing to use in the circumstances with Yatim.
Brauti: When Mr. Yatim is coming forward after being told not to move and drop it and says no, in that incidence did you think he was coming forward.
Forcillo: " I saw what was taking place -- he was deciding to come forward. There's nothing in there that showed he was going to drop the knife."
Crown has wrapped up its cross. Defence lawyer Peter Brauti has started re-examination.
Forcillo disagreed: "Mr. Yatim got shot because he came forward. He's responsible for his actions."
"You failed in your duty to make sure Sammy Yatim went home that night."
Reminded Forcillo that he had testified that he was determined to go home that night.
Rupic: You were not acting like a police officer; you were acting like a court officer moving prisoners around."
You saw his bullets rip into his legs and groin, said Rupic, while he was on his back. A witness who was standing behind Forcillo testified he saw that.
Forcillo said he didn't see that.
As continued those last shots -- Rupic said one of Yatim's shoes was dangling, his legs remained outstretched isn't it? Forcillo said the legs jerked in the air, but agreed Yatim didn't get up.
Rupic said Forcillo didn't consider any other use of force options.
Said Forcillo didn't believe waiting for a taser was reasonable because he looked like he was re-arming himself and was in process of getting up.
Rupic said Forcillo had reasonable alternatives to shooting Yatim while he was down on the ground
Forcillo said it would have taken him a sec to get up from the lying position
Forcillo said he shot him another five times because Yatim looked like he was re-arming himself and getting up.
Forcillo said Yatim was on his back on the floor re-arming himself.
Rupic said that while Yatim was lying on his back, Forcillo knew that he was badly injured. Forcillo said he had no clue where the bullets hit him
The bullets that police use are hollow point bullets, which Rupic said can do more damage if shot into a torso.
Forcillo said he kept his eyes on him and it looked like he was going to get up.
Rupic asks Forcillo whether he tried to talk to Yatim after he fired the first three shots at Yatim and he falls backwards. He said no he didn't

Forcillo disagreed: "If I had done nothing, he would have stabbed me. If I had waited for the taser, he would have been off the streetcar. He forced my hand. He was the one who decided to come forward."
He said Forcillo could have done nothing or waited for the taser to arrive. He had options.
