"In all honesty the events of that night are in my head forever."
She didn't refer to any notes during her testimony
Said she reviewed her Special Investigations Unit statement that she gave the day after the incident. She also reviewed her notes that she wrote up around the same time.
Now crown is asking her questions.
Reality is that video can never create or recapture the emotion and intensity of lethal force in situation. Says you will not understand the heartpounding -- the enormity of the situation that sits with her for the rest of her life.
Forcillo laughs when she said this
She says suggestion that Forcillo was the boss of the situation and other officers were afraid to challenge him is as good as a bag of tricks and is insulting.
She's dismissing many of the the suggestions the Crown's use of force expert has suggested Forcillo could have done other than shoot Yatim.
She said someone wielding a knife is a use of force encounter. Said pepper spray was not an option. Said didn't know about switch to close the streetcar doors. She said even if she knew about it, that this was a dynamic situation and no officer was going to skirt the front of the streetcar to search for a switch.
She said Forcillo had the superior tactical position He was in the direct line of fire. She said Yatim had squared off at doors.
She said when she heard Forcillo fire the first three shots at Yatim, she said she had a jerk reaction like hearing a loud sound. But after that because Mr. Yatim looked like he was coming off the streetcar, it was something I was expecting."
She said she saw Yatim make a deliberate intentional move forward and I thought he was getting off the streetcar.
"I think that its easy to misinterpret and oversimplify my actions that night ... that night was, is the most terrifying moment of my life. We're expected to martial our own fears and deal with the threat and that's what we did that night."
She also said she told her partner she was moving off so she could call for a srgt with a taser.
She said she did ask Yatim whether there was anyone else on board because she was concerned someone might be injured and couldn't get off.
She said she didn't shout commands at Yatim because "It was stressful, adrenalin-drenched, forr Mr. Yatim to understand..." only one person should be giving commands and she wanted Yatim to focus on Forcillo
She said even though she holsters her gun, she keeps her hand on the butt in case she needs to draw it quickly.
she described yatim as hostile, angry and prominently displaying a knife in his right hand.
But she says seeing the video again, she explained "I had determined from the actions of Yatim that he was going to get himself shot." She said she was getting ready to call for a taser.
She reholsters her gun shortly after coming around the corner to the doors of streetcar. She said she didn't recall holstering gun.
"As we're coming around, I don't have a direct line of fire at Mr. Yatim at that point."
She said she drew her gun in low ready position -- so aiming down whereas her partner Forcillo had his gun pointed at Yatim. She said that meet her expectations . Forcillo had a direct line of sight with Yatim. She said she kept her firearm pointed down because police are cautious about misfiring especially in a high stress situation. She said she couldn't see what she was looking at -- that she saw Yatim as a silhouette.
Says no reason why Forcillo given his location from cop car to streetcar shouldn't take the lead
Defence Lawyer Brauti says why not you with more experience take the lead?
Both exited scout car at same time. Forcillo had direct route to front doors of streetcar so logically followed that he would take lead
They exit scout car together. Good number of people on sidewalk. Forcillo calls out to public, "Where is he?" Someone calls back, "On the streetfcar."
She said it would seem logical they she and Forcillo would talk in car but they did not. She said they
had to listen to dispatcher and had no idea what going to encounter in the 60 secs took to get to scene so couldn't formulate plan.
Lot of questions as driving to scene -- is suspect still on streetcar? anyone hurt? how many?
She responded to the dispatcher moments before she and Forcillo got out of the car.
She said they didn't have definitive description of subject because it kept changing.
When she heard dispatcher say No injuries at this time ... suggests at that point in time from caller info coming in there are no injuries but that's info that's only limited to people who have called in. People may be injured but not call in.
Fleckeisen says when dispatcher said the streetcar is stationary she took it to mean it was serious enough a situation that actions have forced the vehicle to stop. She called that alarming.
We are listening and watching the dispatch call synced with what's going on at the scene.
They got back in the scout car and within short order dispatcher got on the air with a Hotshot. An urgent emergency call.
Recognizing that was going to be busy night, she and Forcillo decided to grab a bite to eat and "predictably" went to Tim Hortons.
Said Forcillo in good mood.
They end up in car 7-11. They leave the station about 2330
Says they had to work a parade. After they were assigned their details by the sergeant who warned that it was going to be busy nights because of a beer fest on CNE grounds and lots of outstanding calls.
That July 2013 shooting night, she and Forcillo were working the night shift.
They were becoming friends. She says Forcillo was a capable officer and good father.
We made a good team she said.
Worked with Forcillo starting in May. They worked well together and partnered for the night shifts. They got along
Regularly worked with Forcillo.
Said for night shift always work with partner.
