The trial of Cst. James Forcillo begins this morning. The Toronto police officer is accused of second-degree murder and attempted murder of Sammy Yatim, 18, who was shot on a TTC streetcar in July 2013.Though Forcillo and his defence lawyer, Peter Brauti have not arrived, media is already gathering outside the courthouse at 361 University Ave. in Toronto where the trial will take place.Charges like these against a police officer are extremely rare.Expect details up to the minute from the courtroom.

Forcillo is seated with his defence team. He's not showing any emotion. His lawyer said he's been looking forward to the trial starting so he can share his side of what happened the night Sammy Yatim was shot.Forcillo's wife is also here and in the front row.Yatim's family is not in court right now.

Justice Edward Then is now in the courtroom but the jury has not entered yet. A court refresher: anything said when the jury isn't present cannot be published. So, all this to say, we're still waiting for the official beginning but anticipate opening statements shortly.Those statements from both the crown and defence will tell the jury their positions regarding the charges against Forcillo, in the shooting death of Yatim.

Sorry about the radio silence folks. Just as an update, the lawyers are still working out procedural matters with Justice Then. This is time consuming but happens often in any criminal proceedings. We are restricted in revealing any details as the jury is not present. But I'm still in court and ready to share details as soon as they become available.Also, consider that the accused could face life in prison if convicted and given the public response after Sammy Yatim was shot it is likely reasonable to assume that there's caution on all sides in making sure the details are in order before calling in a jury.
