Good morning, we are about to get started at the Laura Babcock murder trial.Dellen Millard will be first up, as he continues his cross examination of his former mechanic, Shane Shlatman. Here's what he said yesterday: http://www.cbc.ca/news/canada/toronto/babcock-murder-trial-mechanic-1.4402262
-
-
Dellen Millard begins - asking Shane Schlatman about the purpose of the incinerator."Have you heard about a roll out door versus a hatch on the incinerator?" Millard asks.Schlatman says he remembers reading the option in an email from the manufacturer.Schlatman says the roll top door would be similar to a garage door, you'd slide it upward.Millard says "The roll up door would've allowed for larger objects to get in?"Schlatman says it's possible.Millard responds, that they didn't opt for the roll up door.
-
Millard switches gears to the idea that he wanted to start a pet cremation business, with his uncle.Millard: "The idea was he could be a potential customer for this machine, in addition to many other vet clinics and the use of garbage?"Schlatman: "That's right" though he doesn't think the machine was designed to burn garbage.Millard talks about how the plan included potentially going to farms in the Waterloo-area, also looking to drum up business.
-
Millard now asks about the propane tank used for the incinerator, he has Schlatman explain the difference between a propane and diesel burn.Millard: "Was environmental concerns something I cared about?"Schlatman: "Not generally."Millard asks if Schlatman remembers how he wanted to build an electric car. He doesn't.MIllard: "We had a lot of projects."Schlatman: "We did.
-
-
-
Millard asks about racing jeeps.Justice Michael Code tells Millard to move along, asking him about relevance.Millard says he's trying to establish costs. Code repeats for him to move along.Millard now asks Schlatman about the cost of building the hangar - was it in the millions?Schlatman: "About that."Millard says the hangar and tools inside didn't fulfil their intended purposes, like many of his projects with high costs.Schlatman: "That's right."
-
Millard: "Shane, did you know I'm a pilot?"Schlatman: "Yup."Millard now shows a picture of himself with his best friend, Andrew Michalski, and talks about their close relationship.Millard: "Mark never really socialized with you. He never came to your house?"Schlatman: "No."Millard points out, Michalski did.
-
-
Millard: "Do you remember me telling you I had issues with deer hunters at my farm?"Schlatman remembers.Millard tells the court it was a big farm, more than 100 acres, with surrounding farms and marshland.Millard "I specifically told you there were hunters going onto my land and I was trying to stop them?"Schlatman: "Yup."He's giving very brief answers today, "yup" or "correct."
-
-
Millard pulls up some text messages exchanged between him and Shane Schlatman.Millard: "Is it possible on July 4, I would've came to the hangar in the Oldsmobile...and switched vehicles and left with the green van?"Schlatman: "It's possible."The Crown contends Babcock was killed sometime in the evening of July 3, 2012 or the morning of July 4, 2012.Millard now talks about another text. When he told Schlatman about "another dead deer at the farm" He tells the court that was relating to his ongoing headaches with deer at the farm."You were never there when the incinerator was in use, only that initial burn up?"Schlatman: "Yup."
-
Millard shows Schlatman this photo of his farm.
Court exhibit: a photo of Millard's farm in the region of Waterloo. Schlatman: "Oh yes."Millard says the floor board were weak, giving out. -
-
More texts between Millard and Schlatman.Schlatman: "Can you do me a favour while in the us"Millard: "what can i do for you"Schlatman: "bring back a couple of cases of Mgd 64 cans for Tracy" (his wife)Millard: "should be simple enough"Millard tells the court this is an example of the type of relationship the two men had. Schlatman repeats "yup."

Jill Cameron asks about a plan Millard had to start a business with Burns.Burns said he'd never heard about it, until a friend reached out.Burns recalls his friend said "Hey I hear you are going into business with your nephew. I hear you are finally showing some interest in his life."Burns asked his friend "What do you mean? "His friend replied "He's bought this monstrous animal incinerator. He told me you two are going into business together."Cameron asks again, had Burns and Millard ever talked about going into business together?"Never, not with him, or anyone in his entourage," Burns answers.
-
Burns tells the court he already has a long-time working relationship with a pet cremation company."Their service is excellent. When people request pets to be cremated, they offer options for owners, cute things, memorabilia, paw prints, they can make figurines. They are quite creative in their ability to satisfy a client."He repeats he had no intention to change services.Crown Jill Cameron asks Burns if he's ever heard of a mobile pet cremation service."I, in 30 years, had never heard of one. Quite frankly I was blown away. It was the most absurd thing I ever heard of."
-
Burns said he'd "dis-entangled" his family from Millard in 2012.Millard never mentioned the idea to him in person, he testifies."I just remember the useless dribble that came from his mouth."Burns said he was happy Millard didn't bring up the idea."Can you imagine driving up to a strip mall to a vet clinic, carting out cadavers and lighting up an incinerator, with embers flying out right there in the parking lot, and then travelling down Main Street to the next clinic?"
-
The Crown asks if Burns remembers the last time he saw Millard.Burns says he "never bothered to categorize the useless events in his life."Justice Michael Code cautions Burns to stick to the facts, leave out opinion.Burn responds it was July and August in 2012, which he calls "the incinerator year."Burns remembers this year because his son was going to medical school, and his son and daughter went on a trip to Europe. He says Millard invited himself along.
-
-
-
Millard begins by asking Burns about the European trip he took with Burns son and daughter. Millard suggests it was August 2012.Burns says it seems correct but adds, "Whatever date it was, is recorded somewhere, that date through flights and tickets can easily be found."Millard pulls up a selfie of eight people on a boat. Millard in the centre. He asks, "Robbie, is that your son in the centre?"Burns responds yes.Millard: "This is from the European trip?"Burns: "I don't know, I wasn't there."Burns is sitting hunched over in the witness box, looking directly at Millard.
-
Justice Michael Code says the date and location does not seem relevant to this trial.Millard moves along. He shows Burns a photo - the jury has now seen several times - Millard and a petite woman, holding a cat.Millard asks if Burns recognizes the location - he does not.Millard asks, "Do you recognize the cat?"Burns says "It's a black cat." He treated several, he says.
-
Millard now asks about the pet cremation business - that it's growing in popular, people want ashes of their pets.Burns agrees.Millard asks if Burns was in France during the summer of 2012. He doesn't recall.Millard asks Burns to review his June 6, 2013, police statement.Burns says he usually spent summers in the city.
-
Millard talks about a visit he made to Burns' vet clinic. He stopped by and staff told him Burns was away. Now Millard asks about Burns visiting his home -- the one he grew up in -- on Maple Gate Court, in Etobicoke, to treat cats.Burns recalls treating cats at the airport hangar.
-
Millard asks again, was Burns at Maple Gate in the summer of 2012?"I have to be clear that my only role in this tragic and diabolic affair ---- "Justice Michael Code interrupts Burns."You must stop that. You're being asked about your police statement...(he refers back to the statement.)Burns answers, "In all do respect, being pulled into a police station and put into a corner and being asked about YOU. Those are the responses I gave at the time," he says looking at Millard.Code asks again, "did you go to Maple Gate in the summer of 2012. Yes or no?"Burns says he recalls going to the hangar.
-
Millard: "We are not close?"Burns: "No."Millard: "We never talked about the pet cremation business? You were told by Charles Dubien" (this is the friend we heard about earlier).Millard adds: "It never came up as a subject."Burns: "It most certainly didn't."Millard: "Is it in the realm of possibility that I would learn of your clinic learning about disposing about animals through incineration through your staff?"Justice Code says that's a difficult question to ask. Re-frame it.Burns says he can't say what Millard and his staff may have spoken about, when he was not there.

-
-
-
The Crown's questioning is brief.Dellen Millard is now up for cross-examination.Millard, "Do you remember me?"Grant, "Vaguely."Millard talks about the invoice - it's a manual slip, handwritten. He now shows the court a picture of bank cards spread out on a table. There are four Visa cards, a Costco membership, two RBC debit cards.Millard points out it's not his name on the slip. The customer is listed as "Millard Air."
-
-
Crown Katie Doherty now reads an admission to the jury, about a Blue GMC Yukon. She says, "In the spring of 2013, Millard was stopped while driving a Blue GMC Yukon. It was searched."Doherty now shows us a number of photos of the vehicle. We see the inside, there is chocolate milk on the passenger seat. Loose change. Debit and credit cards. There are two large buckets. We also see a reddish-orange bag (looks like a gym bag), and a folder with papers inside.

He's a Toronto police officer, a job he's held for more than 20 years.Crown Cameron says Det. Jansz is an expert in analysis and interpretation in codified language and urban street language.Jansz says urban street language is "words or phrases that have been combined or the creation of new words."Codified language is "similar to street language. The difference is that it's codified, something done consciously to prevent the comprehension of the public and law enforcement."
-
He says he got the expertise by reading research papers and books written on the topic, attending conferences and watching documentaries.Urban street language he says has now found its way into the dictionary, it's become very common.Codified language he repeats is used to avoid detection.
